We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site or purchasing a Wine Bar Shelf from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein (including our Privacy Policy, Shipping Policy, and Return & Refund Policy).

2. GENERAL CONDITIONS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.

• You may not use our products for any illegal or unauthorized purpose.

• We reserve the right to refuse service to anyone for any reason at any time.

• You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

3. PRODUCT DISCLAIMER (NATURAL WOOD)

Favofam specializes in solid wood furniture. By purchasing from us, you acknowledge and agree to the unique characteristics of natural materials:

• Natural Variations: Wood is a living material. Differences in grain pattern, mineral streaks, pinholes, knots, and slight color variations are natural characteristics of the timber and are not considered defects. No two shelves are exactly alike.

• Color Accuracy: We have made every effort to display as accurately as possible the colors and images of our products. However, we cannot guarantee that your computer monitor’s display of any color will be accurate.

• Dimensions: All dimensions are approximate. While we strive for precision, slight variances (up to 0.25 inches) may occur due to the handcrafted nature of the manufacturing process.

4. INSTALLATION & SAFETY WARNING (CRITICAL)

Please read carefully. The safety of your installation is ultimately your responsibility.

• Installation Responsibility: Favofam provides high-quality mounting hardware intended for standard installation (e.g., into solid wood studs or masonry). It is the customer’s responsibility to ensure the wall structure is capable of supporting the weight of the shelf plus the weight of the wine bottles.

• Weight Capacity: You agree not to exceed the stated weight capacity of the shelf. Overloading the shelf may result in structural failure.

• Liability Disclaimer: Favofam is NOT liable for:

  • Any damage to your wall or property resulting from improper installation.

  • The breakage or loss of wine bottles, glassware, or other contents stored on the shelf.

  • Personal injury resulting from the shelf falling or detaching from the wall due to poor installation or overloading.

• Recommendation: If you are unsure about how to install the shelf securely, we strongly recommend hiring a professional handyman or carpenter.

5. PRICING AND MODIFICATIONS

• Currency: All prices are listed in US Dollars (USD).

• Changes: Prices for our products are subject to change without notice due to fluctuations in lumber costs or shipping rates.

• Taxes:

  • US Orders: Sales tax is calculated at checkout based on your state.

  • International: We operate on a DDP (Delivered Duty Paid) basis. Import taxes and duties are included in the final price.

6. BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us.

• Order Limits: We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

• Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases. This includes a valid phone number, which is strictly required for shipping coordination.

7. SHIPPING AND DELIVERY

• Risk of Loss: All items purchased from Favofam are made pursuant to a shipment contract. This means that the risk of loss passes to you upon our delivery to the carrier. However, we will assist you in filing claims for lost or damaged packages.

• Address Accuracy: You are responsible for providing a correct shipping address. If a package is returned to us due to an incorrect address, you will be responsible for the reshipping cost.

8. RETURN AND REFUND

Our returns are governed strictly by our Return & Refund Policy.

• Fees: You acknowledge that “Change of Mind” returns are subject to Return Shipping Costs and a 20% Restocking Fee.

• Condition: Items must be returned unmounted (never installed) and in their original packaging to be eligible for a refund.

9. THIRD-PARTY TOOLS AND LINKS

We may provide you with access to third-party tools (such as Stripe, PayPal, or Order Tracking widgets) over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties.

Your submission of personal information through the store is governed by our Privacy Policy. We protect your data using industry-standard encryption.

11. ERRORS, INACCURACIES, AND OMISSIONS

In no case shall Favofam, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

Specifically: We are not liable for incidental damages such as damage to expensive wine collections caused by the failure of the product if such failure is due to improper installation, misuse, or environmental factors (humidity/earthquakes).

13. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Favofam and our affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.

14. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.

15. CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes.
